1. Terms and Conditions
1.1 Acceptance of Terms
By accessing, using, or engaging with any website, platform, software product, consulting service, or technology solution operated by MFI, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions, our Privacy Policy, and our Refund Policy.
If you do not agree with any part of these terms, you must immediately discontinue use of all MFI services.
1.2 Definitions
- “MFI” refers to the Philippine-registered company providing technology, consulting, product development, and related services.
- “Client” or “User” refers to any person or business accessing or purchasing from MFI.
- “Services” includes consulting, software development, custom solutions, subscription modules, SaaS products, and other professional services.
- “Products” refers to physical goods such as hardware, devices, and other tangible items sold by MFI.
1.3 Scope of Services
MFI offers:
- Technology consulting and strategic advisory
- Software development and product engineering
- AI, automation, data, and digital transformation solutions
- Implementation, integration, and system customization
- SaaS and platform access
- Hardware procurement related to solutions delivered
Clients acknowledge that these are professional services and may involve customized, iterative, and collaborative development work.
1.4 Professional Services Are Non-Refundable
All payments for consulting, software development, product development, engineering, customization, or any professional services are strictly NON-REFUNDABLE.
This policy exists because:
- Clients are expected to review proposals, specifications, and invoices prior to payment.
- Work begins immediately upon payment, involving manpower, engineering time, and allocated resources.
- Payments signify acknowledgment that deliverables, scope, and costs were understood without dispute.
Clients who do not agree with the presented deliverables, timelines, or fees must dispute or clarify before payment, not after.
1.5 Use of MFI Platforms
Users must not:
- Interfere with system operations or security
- Reverse-engineer or attempt unauthorized access
- Misuse data, APIs, or software functions
- Engage in activities that violate Philippine laws, privacy regulations, or intellectual property rules
1.6 Intellectual Property
Unless explicitly stated otherwise in a signed agreement:
- All source code, algorithms, architectures, designs, and materials developed by MFI remain the sole intellectual property of MFI.
- Clients may receive usage rights, licenses, or deployment rights as defined in the relevant agreement.
1.7 Limitation of Liability
MFI shall not be held liable for:
- Client misuse or misconfiguration of systems
- Losses arising from third-party integrations or services
- Downtime caused by external providers (cloud services, telco networks, hosting, etc.)
- Indirect, incidental, or consequential damages including profit loss, data loss, or system exposure
Maximum liability is limited to the amount paid for the specific service or product, unless Philippine law mandates otherwise.
1.8 Changes to Terms
MFI reserves the right to update these terms at any time. Continued use of MFI services constitutes acceptance of updated terms.
2. Privacy Policy
2.1 Commitment to Privacy
MFI is committed to protecting client data in compliance with the Philippine Data Privacy Act of 2012 (RA 10173).
We collect only the data necessary for:
- Account creation
- Service delivery
- Support and troubleshooting
- Billing and compliance
- Platform improvement
2.2 Information We Collect
We may collect:
- Personal details (name, email, contact information)
- Business information
- System and device metadata for diagnostics
- Transaction and payment records
- Usage logs for security and performance
2.3 How We Use Collected Data
Data is used to:
- Provide and maintain MFI services
- Authenticate users
- Process orders and deliverables
- Improve system performance and security
- Conduct analytics and product enhancement
We do not sell personal data.
We do not share data with unrelated third parties.
We may share data with trusted service providers only when necessary (e.g., cloud hosting, payment processors).
2.4 Data Security
MFI implements:
- Encryption of sensitive data
- Network and server hardening
- Access-control policies
- Continuous monitoring
However, no digital system can guarantee 100% protection; clients understand inherent risks when using any online service.
2.5 Data Retention
Data is retained only for as long as necessary to:
- Comply with regulations
- Support ongoing services
- Maintain accurate financial and audit records
Users may request deletion of their data unless retention is legally required.
2.6 Cookies and Tracking
MFI platforms may use cookies to:
- Improve user experience
- Save session info
- Provide analytics
Users may disable cookies in their browser settings, though this may reduce functionality.
2.7 User Rights
Under RA 10173, users have the right to:
- Access their data
- Request correction
- Withdraw consent
- Lodge complaints with the National Privacy Commission

3. Refund Policy
3.1 General Policy
MFI does not automatically issue refunds.
Refunds are handled strictly on a case-by-case basis, subject to the conditions below.
A refund request does not guarantee approval.
3.2 Non-Refundable Items
The following are 100% non-refundable:
A. Professional Services
- Technology consulting
- Software development
- Custom engineering
- System setup, integration, or configuration
- Project-based or retainer-based services
- Research, architecture, analysis, and design work
Once payment is made, clients acknowledge:
- No confusion exists regarding deliverables
- Work and hours have been allocated
- Skills, expertise, and time cannot be “returned” or “undone”
This follows the nature of professional service industries worldwide.
B. Subscription Fees
Paid fees for monthly, quarterly, or annual SaaS subscriptions are non-refundable once access is granted.
3.3 Refund Eligibility for Physical Goods Only
Refunds or credit memos for physical products may only be considered if:
- The item does not satisfy its specific warranty,
- The defect is verified, and
- The warranty period indicated on the invoice or purchase order is still valid.
Each product has its own warranty type, coverage, and duration.
Not eligible for refunds if:
- The client changed their mind
- The item was mishandled or damaged by the client
- The defect falls outside the warranty coverage
- The warranty period has expired
3.4 Replacement and Credit Memos
If a physical product is eligible under warranty:
- MFI may replace the item, or
- Issue a credit memo, at MFI’s discretion
Refunds are considered the last option, not the default one.
3.5 Proof Requirements
Clients must provide:
- Official purchase documentation
- Serial numbers, photos, or videos of the defect
- Access to the physical item for inspection
MFI may require additional documentation or technical assessments.
3.6 Processing Time
Warranty evaluations and refund/credit decisions are typically processed within 7–21 business days, depending on the complexity and supplier involvement.
